Rental Agreement

By purchasing from Pack Stack Go (“PSG”), I accept the terms and conditions of the rental agreement below:

1. Delivery: PSG will deliver the rental Equipment to Renter’s doorstep, garage, or curbside on the ground level. Stairs are not included. Renter or delegate over the age of 18 is required to be home to sign for the delivery. If Renter or delegate are not present for delivery, PSG can leave bins in designated outdoor area with client approval via text. The client assumes liability for bins at delivery, regardless of if they are present. The PSG driver will text a photo proof of delivery which will include house address and photo of bin location.

2. The Renter agrees to keep the equipment in his/her custody and not to sublease, rent, or sell the equipment. Equipment will remain in the possession of the Renter but are the property of PSG. Renter accepts responsibility for all loss or damage to the PSG bins. If the PSG bin are damaged or lost while in the Renters possession the Renter will be obligated to pay the full retail value of the bins. Retail value of the bins are $25.00 each.

4. No alteration to the Equipment may be made. Only labels, provided by PSG to Renter, are permitted to be used on Equipment. Tape is prohibited from being used on Equipment. If Renter desires to additionally secure the Equipment zip ties may be used. In addition, no permanent markings on any area of the bin is acceptable. If any rented bin is marked permanently while in the Renters possession the Renter will be obligated to pay the full retail value of the bin. Proper care and maintenance of the Equipment during its use will be the responsibility of Renter. Equipment which is returned in a condition requiring cleaning or repairs due to excessive wear and tear or mishandling will be brought back to a rentable condition at the expense of Renter. The bins have a grooved bottom to prevent slippage while transporting bins; it is not recommended that they be placed on soft or uncovered surfaces. PSG is not liable for any damages caused by non-adherence to this policy.

5. Renter acknowledges that he/she has care, custody, and control of the PSG Go Dolly while the Go Dolly is at the Renter’s location. Renter accepts responsibility for all loss or damage to the Go Dolly. If the Go Dolly is damaged or lost while in the Renters possession the Renter will be obligated to pay the full retail value of the Go Dolly. Retail value of the Go Dolly is $75.00 each.

6. If applicable, renter acknowledges that he/she has care, custody, and control of the PSG 2-wheel dolly while the 2-wheel dolly is at the customer’s location. Renter accepts responsibility for all loss or damage to the 2-wheel dolly. If the 2-wheel dolly is damaged or lost while in the Renters possession the Renter will be obligated to pay the full retail value of the 2-wheel dolly. Retail value of the 2-wheel dolly is $50.00 each.

7. If the Renter does not give 24-hour notice to reschedule appointments there may be an additional cancellation fee or delivery fee applied in the amount of $25.00.

8. In the event the equipment is not ready for pick-up at the agreed upon time, then a $25.00 late fee shall be automatically imposed per day until the equipment is returned to PSG.

9. Renter acknowledges the rental terms are for the initial rental period based on the amount rented and paid in full prior to delivery. Any week after the initial rental period, renter will be charged $4.00/week per bin until pick up has been scheduled.

10. PSG will not under any circumstance share any Renter’s personal information with any other party at any time.

11. Indemnification. I agree to indemnify and hold you, your officers, agents, and employees harmless from and against all liabilities, claims, actions, proceedings, damages, losses, cost and expense, including attorney’s fees, for all injuries or death of any person or damage to any property occurring or arising from or connected with directly or indirectly, my possession, use and return of any of the product(s). The Renter shall be in charge of the product(s) operation and is fully responsible for its operation as well as the return of the product(s) in good working orders. PSG and its officers, employees and agents are not responsible for injury occurring to the Renter or to any other persons using the product(s), and the Renter further agrees to hold PSG and its officers, employees, and agents harmless against any injury or property claims. The Renter shall indemnify PSG and its officers, employees and agents from/against any cost incurred due to claims from anyone and for attorney’s fees and related costs involving the use and return of the product(s), should any legal action become necessary.

12. PSG warrants that the product(s) rented under this Rental Agreement will be in good working order on the effective date of the Rental Agreement. Product(s) supplied and maintained subject to this warranty. PSG’s obligation under this Rental Agreement is limited to repairs or replacement of the product(s) when the Renter determines that it does not conform to this warranty.

13. Renter acknowledges that their credit card will be kept on file for the duration of the Rental Agreement. Renter acknowledges and authorizes PSG to charge any amount associated with the above stated terms and conditions.

14. Renter shall pay all applicable sales/rental taxes on Equipment.
